    At Berardi Immigration Law, we recently had the privilege of assisting one of our clients with the renewal of their E-2 visa. This client had previously secured an E-2 visa based on a substantial investment in their U.S. company, which specializes in distributing high-quality cotton fabrics for quilting, crafting, and home decor. As their initial visa approached its expiration, they sought our guidance on renewing their status and ensuring continued operations in the United States.

    The E-2 Visa Process

    When renewing an E-2, it is essential to demonstrate that all E-2 visa requirements continue to be satisfied. The U.S. business must remain majority-owned and controlled by citizens of the relevant treaty country, and the company must not be classified as marginal, meaning it must show significant growth, the hiring or U.S. workers, profitability, and potential l for continued expansion.

    Working closely with the client, we prepared a comprehensive application for submission to the U.S. Consulate in Toronto. This application emphasized key details about the client’s business, including its current workforce of U.S.-based employees, impressive revenue figures, and future business plans in the U.S. market. These factors demonstrated that the business was thriving and poised for continued success.

    The Outcome

    Our client attended an in-person visa interview and was issued another five-year E-2 visa! Furthermore, their U.S. company was re-registered as an E visa business under the Canada E visa program, ensuring that it can continue to sponsor additional Canadian citizens for E-2 visas over the next five years.

    This success is a testament to the client’s hard work and commitment to building a profitable U.S. business and to the meticulous preparation we invest in each case. We are excited to continue supporting our client as they grow their business and contribute to the U.S. economy!
