    Expanding a UK Software Business to the U.S. with an E-2 Visa

    A successful software entrepreneur from the United Kingdom recently approached our firm to explore the possibility of expanding their business to the United States. The client aimed to open a U.S. subsidiary to tap into business opportunities available in the American market.

    Forming a U.S. Subsidiary for E-2 Eligibility

    To kickstart the expansion, the client formed a U.S. company and made a significant initial investment to support its operations. These investments covered critical startup costs, including legal fees, participation in trade shows, travel expenses, office rent, and various administrative and professional fees. With the groundwork laid, we began preparing their E-2 visa application.

    Crafting a Successful E-2 Application for U.S. Expansion

    Our team worked closely with the client to craft a comprehensive E-2 visa application. The submission to the U.S. Embassy in London detailed the client’s business plan, highlighting their commitment to generating substantial revenue and creating jobs for U.S. workers. The application also showcased the client’s industry expertise and the strategic importance of their software solutions in the U.S. market.

    Securing a Five-Year Visa for U.S. Business Growth

    After attending an in-person interview at the U.S. Embassy in London, the client was issued a five-year E-2 visa. This allowed them to actively manage and grow their U.S. subsidiary. Additionally, the company was registered as an E visa business under the United Kingdom E visa program. This registration enables the company to sponsor U.K. citizens for E-2 visas, providing flexibility to bring on new hires or relocate existing personnel from the U.K. to support the U.S. operations.

    With the E-2 visa in place, the client is now well-positioned to expand their software business and leverage opportunities in the U.S. market. Their investment will not only contribute to the U.S. economy but also create valuable job opportunities for local talent.
