At Berardi Immigration Law, we are honored to assist entrepreneurs in bringing their business goals to life in the United States. One of our recent clients, a seasoned Canadian business owner in the construction industry, successfully obtained an E-2 visa to launch a new U.S.-based affiliate of their thriving Canadian company.

Expanding Across Borders: A Vision for Growth

Our client approached us with a well-defined vision: to establish a U.S. construction company that would serve as an extension of their successful Canadian operation. With a strong foothold in Canada’s residential and commercial construction sectors, the client saw a strategic opportunity to expand into the U.S. and meet rising demand for high-quality, reliable construction services.

Laying the Foundation: Investment in a New U.S. Entity

Rather than acquiring an existing business, our client chose to create a brand-new U.S. company affiliated with their Canadian headquarters. The investment included startup capital, the purchase of construction equipment, leasing of office space, and other miscellaneous startup expenses. The business plan also detailed plans for securing contracts, building relationships with local suppliers and subcontractors, and scaling operations over time.

Building a Strong E-2 Visa Case

Our team worked closely with the client to develop a compelling E-2 visa petition that showcased their substantial investment, industry expertise, and the economic impact of their new U.S. operations. We submitted a comprehensive business plan outlining the company’s services, projected financial growth, job creation strategy, and operational structure. The application emphasized the affiliate relationship between the Canadian and U.S. entities, highlighting a clear path for sustained cross-border collaboration.

From Blueprint to Reality: Visa Approval and Launch

After careful preparation, the client attended their visa interview at the U.S. consulate in Toronto and was approved for a five-year E-2 visa. This allowed them to immediately take the reins of the new company, oversee project bids and site operations, and begin building a solid presence in the U.S. construction market.

Future Expansion and E Visa Registration

Following visa issuance, we also registered the new U.S. entity as an E visa business. This registration now enables the company to sponsor additional Canadian employees for E-2 visas—supporting key roles such as project managers, estimators, and skilled tradespeople. With a growing portfolio of U.S. projects, the company is positioned for long-term success and continued cross-border growth.

    Conclusion

This E-2 visa story illustrates how experienced business owners can expand into the U.S. by establishing new affiliate companies and making a qualifying investment. With the right planning and legal support, our client was able to enter the U.S. construction market strategically and lay the groundwork for future success.

If you’re considering expanding your business to the United States through the E-2 visa program, the team at Berardi Immigration Law is here to help. Contact us today to learn how we can assist with your next big move.
