    What is the E-3 Visa?

    The visa is specifically designed for Australian citizens seeking employment in the U.S. in specialty occupations. A specialty occupation is one that requires:

    1. Theoretical and practical application of specialized knowledge; and
    2. A bachelor’s degree or higher (or its equivalent) in the relevant field.

    Applicants must demonstrate that the offered position necessitates a degree in the specified specialty and that they meet the qualifications through their educational credentials, licensure, and/or work experience.

    Key Features:

    • Employer-Specific Work Authorization: Visa holders can only work for the employer listed in the approved petition.
    • Validity: The visa is valid for up to two years, with the possibility of renewal.
    • Dependents: Spouses and unmarried children under 21 can accompany the primary visa holder. Spouses are also eligible to work in the U.S.

    Employer Requirements

    To sponsor an E-3 visa, the U.S. employer must meet specific obligations, including:

    • Pay the Prevailing Wage: The employer must offer at least the prevailing wage for the position in the location where the work will be performed.
    • Obtain a Certified Labor Condition Application (LCA): The LCA must be certified by the Department of Labor before submitting the E-3 petition.
    • Maintain Compliance: Employers must document compliance with the LCA requirements in a Public Access File (PAF), which includes details about the position, wage, work location, and employment period.

    Application Process

    The primary method for applying for an E-3 visa is to submit an application in person at a U.S. Embassy or Consulate abroad. Alternatively, if the applicant is lawfully present in the U.S., the employer can file a petition with USCIS. However, if USCIS approves the petition, the applicant must still apply for a visa abroad to reenter the U.S. after any international travel.
