    Congratulations to those who have recently been selected in the H-1B visa lottery! This is a significant milestone, and as you prepare for the next steps, it’s crucial to understand the concept of the “Cap Gap” and its implications for your status and travel plans. The Cap Gap extension is an important provision designed to protect the status of students under F-1 visas as they transition to H-1B status, but there are specific limitations and details you need to be aware of.

    What is the Cap Gap?

    The Cap Gap occurs when an F-1 student’s status and OPT / STEM OPT work authorization expire before their approved H-1B status begins on October 1st. The U.S. Citizenship and Immigration Services (USCIS) provides a Cap Gap extension to bridge this gap. This extension automatically extends the F-1 status and, if applicable, the employment authorization of students who have an approved or pending H-1B petition. Note that Cap Gap benefits do NOT apply to students enrolled in CPT.

    Coverage of the Cap Gap

    The Cap Gap extension applies from the time your current F-1 status and work authorization expire until your H-1B status begins on October 1st. If your H-1B petition is filed before your F-1 status expires, and you are selected in the lottery, your F-1 status is extended automatically. This extension allows you to remain in the United States until the H-1B process transitions to active status, assuming no other violations or issues arise that could affect your legal status.

    Limitations of Travel During Cap Gap

    A critical advisory for H-1B applicants under the Cap Gap extension is regarding travel: we generally advise against leaving the United States between the filing date of your H-1B petition and October 1st. The reason is straightforward: if you depart the U.S. during this period, you will not receive an extension of stay as part of your H-1B approval. While your H-1B petition may still be approved, activating your new H-1B status requires you to obtain an H-1B visa from a U.S. consulate abroad post-October 1st and re-enter the U.S. This process can be time-consuming and has its risks, as visa issuance is subject to administrative processing and other potential delays.

    Cap Gap Does Not Apply to STEM OPT Extensions

    It’s important to note that the Cap Gap does not apply to those who are in the process of applying for STEM OPT extensions. If you are an F-1 student applying for a STEM OPT extension and have timely filed your Form I-765 for work authorization, you can automatically continue to work while your application is being processed. This provision ensures that your employment and status in the U.S. are maintained independently of the H-1B process.
