While your H-1B petition may still be approved, activating your new H-1B status requires you to obtain an H-1B visa from a U.S. consulate abroad post-October 1st and re-enter the U.S. This process can be time-consuming and has its risks, as visa issuance is subject to administrative processing and other potential delays.
Cap Gap Does Not Apply to STEM OPT Extensions
It’s important to note that the Cap Gap does not apply to those who are in the process of applying for STEM OPT extensions. If you are an F-1 student applying for a STEM OPT extension and have timely filed your Form I-765 for work authorization, you can automatically continue to work while your application is being processed. This provision ensures that your employment and status in the U.S. are maintained independently of the H-1B process.
