    Navigating the complex landscape of U.S. immigration can be daunting for many aspiring entrepreneurs. At Berardi Immigration Law, we recently had the opportunity to guide a Canadian client through this process, enabling them to expand their property management and home renovations business into the United States. 

    Initial Consultation and Strategic Planning

    Our journey began when a seasoned entrepreneur approached our firm with the vision of opening a U.S. company in the property management and home renovation sector. After a detailed discussion, it was determined that the E-2 Treaty Investor Visa was the best option.

    Setting Up the Foundation

    To facilitate this expansion, the client formed a Limited Liability Company (LLC) in the U.S. They made significant investments in the business, covering a broad spectrum of startup necessities including equipment purchases, legal and consulting fees, marketing initiatives, leasehold improvements, and office setup costs. These initial steps were critical in establishing a solid foundation for their U.S. operations.

    Navigating the Visa Application Process

    With the business groundwork in place, our team prepared and submitted an E-2 Treaty Investor Visa application on behalf of the client. The application was meticulously compiled to meet all the stringent requirements set forth by the U.S. immigration regulations. After submission, our client attended an in-person interview at the U.S. Consulate in Toronto, where their application was successfully approved, granting them a five-year E-2 visa.

    Expanding the Team

    The approval of the E-2 visa was not only a milestone for our client but also a gateway to further expansion opportunities. The client’s U.S. company was registered under the Canada E visa program, which enables the business to sponsor additional Canadian citizens for E-2 visas. This provision is particularly beneficial for companies looking to transfer key personnel to support their U.S. operations.

    Family Considerations

    An equally important aspect of this success was the issuance of an E-2 dependent visa to our client’s spouse, empowering her to pursue employment opportunities in the U.S. This not only supports the family’s transition to a new country but also enhances their ability to integrate into the U.S. community and economy.
