The REAL ID Act, passed by Congress in 2005, created a set of security standards for state-issued driver’s licenses and identification cards. While much of the public attention has focused on how this affects domestic air travel, REAL ID compliance also plays a crucial role in accessing certain federal buildings, including those used by immigration agencies. For visa applicants and individuals involved in immigration proceedings, understanding these requirements is especially important.

Federal Building Access Under the REAL ID Act

Starting May 7, 2025, individuals aged 18 and older will need a REAL ID-compliant license or another approved form of identification—such as a valid passport or a DHS-issued document—to board domestic flights or enter certain federal facilities. These facilities include military bases, federal courthouses, and administrative buildings where government agencies conduct sensitive operations.

In everyday terms, this means that if you are visiting a federal building where ID is required for entry, a non-compliant state ID may no longer be accepted. This rule does not apply to federal buildings that are open to the public without identification, but it does affect any location where security screenings are in place.

Why REAL ID Matters for Immigration Appointments

For non-citizens navigating the immigration system, the implications of REAL ID go beyond travel. Many immigration-related services take place in federal buildings, such as U.S. Citizenship and Immigration Services (USCIS) offices, immigration courts, and Department of Homeland Security locations. These are precisely the types of facilities where REAL ID requirements will be enforced.

This is particularly relevant for visa applicants, green card holders, and asylum seekers attending scheduled appointments such as biometrics, interviews, or hearings. Without a REAL ID-compliant document or an acceptable alternative like a valid passport, individuals may be denied entry to the building. This could result in missed appointments and unnecessary delays in their immigration process.

How to Obtain a REAL ID-Compliant Card

REAL ID-compliant licenses and identification cards are marked with a star in the top corner. To get one, applicants must visit their local Department of Motor Vehicles (DMV) office in person and present specific documents. These typically include proof of identity, lawful status in the U.S., a Social Security number, and state residency. The exact requirements vary by state, but many non-citizens with lawful immigration status are eligible.

Because of the documentation involved, it’s wise to start the process early, especially if you have upcoming immigration appointments. Having a compliant ID or a valid passport on hand ensures you can access the necessary federal facilities without issue.

Planning Ahead to Avoid Immigration Delays

Immigration timelines are often sensitive and delays can have serious consequences. Whether you are applying for a visa, adjusting your status, or appearing for a biometrics appointment, it is essential to have the right identification to avoid last-minute issues. Carrying a REAL ID or passport ensures you can access secure government buildings when needed.

    Conclusion

Individuals involved in the immigration system should take proactive steps to ensure their identification meets REAL ID standards. This is not just a matter of travel convenience, it directly affects your ability to attend critical appointments and access immigration services.

If you have questions about which forms of identification are accepted or how this might impact your immigration case, don’t be afraid to contact our team of immigration professionals at Berardi Immigration Law. Being prepared helps keep your immigration journey on track.
